TERMS OF USE
These Terms of Use (the “Terms”) govern the use of the Hejj platform (the “Platform”) and the services and features provided through it (the “Services”) by Hejj BV, a company registered under Belgian law with registered office at [insert address], company number [insert], and available via info@hejj.io (“Hejj”, “we”, “us”).
These Terms apply to all visitors and registered users (“you”, “your”, or the “Customer”). By accessing or using the Platform, you agree to be bound by these Terms.

PART A: GENERAL INFORMATION

2. Acceptance and Scope
2.1 These Terms govern your use of the Platform and Services. You agree to them by using the Platform.
2.2 If you represent a legal entity, you confirm you are authorized to accept these Terms on its behalf.
2.3 These Terms may be supplemented by a separate commercial agreement. In case of conflict, that agreement prevails to the extent of inconsistency.
3. Additional Policies
3.1 Our Privacy Policy and Cookie Policy form an integral part of these Terms.
PART B: CONDITIONS RELATING TO USE OF THE PLATFORM
4. Use of the Platform
4.1 The Platform is provided as a SaaS service to professional users. Consumer use is not permitted.
4.2 You are granted a limited, non-exclusive, non-transferable, revocable right to use the Platform, conditional on your compliance with these Terms.
4.3 Each user account is personal. Shared accounts are prohibited.
4.4 The Platform is available in English. Communications will be in this language unless otherwise agreed.
4.5 You are responsible for securing your own access, devices, and network.
5. Prohibited Use
5.1 You agree not to: - Use the Platform in violation of laws - Infringe on intellectual property rights - Attempt to gain unauthorized access - Distribute malware or spam - Reverse engineer or scrape the Platform - Create derivative or competing services
6. Intellectual Property
6.1 All intellectual property rights in the Platform and its content belong to Hejj or its licensors.
6.2 Nothing in these Terms transfers any IP rights to you.
6.3 We may use feedback or suggestions from users to improve our Services.
7. Third-party Services & Links
7.1 Links to third-party services are provided for convenience. We do not assume responsibility for their content or terms.
8. Account Security and Access
8.1 Notify us immediately of any unauthorized access or suspected breach.
8.2 We reserve the right to suspend access if we suspect misuse or security threats.
PART C: SUBSCRIPTION, PRICING & TERMINATION
9. Plans and Pricing
9.1 Hejj offers two standard packages: - Essential: €3 per employee/month - Pro: €5 per employee/month
9.2 Pricing is valid for up to 100 users. For larger teams, contact info@hejj.io for custom pricing.
9.3 Pricing is based on the number of active users per year. User counts are adjusted for each billing cycle.
9.4 All fees exclude VAT unless stated otherwise.
10. Ordering & Eligibility
10.1 Only professionals aged 18+ may use the Platform. You represent and warrant that all registration and billing information is accurate.
11. Billing and Payment
11.1 Subscriptions are billed annually upfront, unless otherwise agreed in writing.
11.2 Payment is due within 30 days of invoice date.
11.3 Late payments are subject to 12% interest and a 10% collection fee (min €200).
11.4 Invoices are deemed accepted unless disputed within 14 days.
11.5 We may suspend access in case of late or non-payment.
12. Subscription Term and Termination
12.1 Subscriptions are annual and automatically renew for 12 months unless cancelled with one (1) month notice before the renewal date.
12.2 Termination can be done via email to info@hejj.io. No formal notice is required.
12.3 Early termination does not entitle you to a refund.
12.4 You may request upgrades (more users or Pro plan) at any time; these are billed pro rata.
PART D: LEGAL & DATA PROVISIONS
13. Data Privacy
13.1 We process data according to GDPR and our Privacy Policy.
13.2 A Data Processing Agreement (DPA) is available on request.
14. Availability and Maintenance
14.1 We aim for 99.5% uptime annually.
14.2 Planned maintenance will be announced in advance when possible.
14.3 We are not liable for unavailability due to force majeure, third-party failure, or security incidents.
15. Disclaimer & Limitation of Liability
15.1 The Platform is provided “as is.” We make no warranties regarding specific results or fitness for a particular purpose.
15.2 Our liability is limited to the total fees paid by you in the 12 months before the incident.
15.3 We are not liable for indirect damages such as loss of profits, revenue, or data.
15.4 You indemnify us against third-party claims resulting from your use of the Platform in violation of these Terms.
16. Logs and Monitoring
16.1 We log activities for security and evidence purposes. These logs may be used in case of disputes.
PART E: FINAL CLAUSES
17. Modifications to the Terms
17.1 We reserve the right to update these Terms. Updates take effect upon publication.
17.2 Continued use after changes implies acceptance.
17.3 You should check these Terms periodically.
18. Assignment
18.1 You may not assign this agreement. We may assign our rights in case of reorganization or acquisition.
19. Severability and Waiver
19.1 If any clause is invalid, the remainder shall remain enforceable.
19.2 Failure to enforce any clause shall not constitute a waiver.
20. Governing Law and Jurisdiction
20.1 These Terms are governed by Belgian law.
20.2 All disputes shall be submitted to the competent courts of Ghent, Belgium.
